3. Use of Software

• No commercial use, AI bots, reverse engineering, or manipulation of the software is allowed.
• Actions must be personally executed by the user through the provided interface.

4. Password Security

You are responsible for maintaining the confidentiality of your password. WinzPot will not be liable for any losses resulting from unauthorized account access.

5. Eligibility and Jurisdiction

• Minimum Age: 18 years
• Residency: Indian residents only
• Restricted States: No paid contests in Assam, Andhra Pradesh, Odisha, Telangana, Nagaland, and Sikkim due to local laws
• Email: A valid email address is mandatory

6. Breach and Consequences

• Permanent account freeze
• Seizure of wallet funds

7. Governing Law and Dispute Resolution

8. Content Ownership and Use

All platform content is protected by intellectual property laws. By using our platform, you allow WinzPot to use user-generated content (messages, data, etc.) for platform enhancement and analytics.

9. Contest Formats

• Public Contests: Open to all users with pre-set participant numbers
• Private Contests: User-created; if not filled, may convert to public

10. Indemnity

You agree to indemnify WinzPot against any claims, damages, or losses resulting from:

1. Intellectual property infringement
2. Defamatory or illegal content
3. Misuse of account
4. Technical issues or data loss
5. Unauthorized access

11. GST Deduction Policy

• 28% GST deducted from deposits and credited back as discount points
• Discount points expire after 90 days
• Can be used toward entry fees

12. Wallet Top-Up & Withdrawals

• All deposits are final unless a transaction error is verified
• Refund requests must be made within 3 working days
• Refunds issued via original payment method
• Inactive wallet balance may be forfeited after 365 days

13. Legality of Fantasy Gaming

WinzPot hosts Games of Skill, not chance. These are legal under the Public Gambling Act, 1867, except in restricted states. Skill includes knowledge, strategy, experience, and expertise.

14. Fantasy Score and Feeds

WinzPot uses third-party data providers for match stats. In case of discrepancies, attempts will be made to rectify them. WinzPot is not liable for third-party data errors.

19. TDS (Tax Deduction at Source) Policy

Effective from 1 April 2023, in compliance with Finance Act, 2023:

• 30% TDS on net winnings at withdrawal
• TDS on year-end wallet balance considered as withdrawal
• Net winnings = Total Withdrawals – Total Deposits (within financial year)
• TDS not deducted if the user is in net loss

20. Conclusion

By registering and playing on WinzPot, you acknowledge that you have read, understood, and agreed to abide by these Terms and Conditions. Failure to do so may result in account suspension or legal action.
